UNIVERSITYTUTOR.COM RULES AND REGULATIONS FOR ESSAY CONTEST
1. General Rules
From the contest start date through the contest end date (the “Contest Period”), UniversityTutor.com will conduct a scholarship essay contest by posting a monthly essay prompt (the “Contest”) located at UniversityTutor.com (the “Website”). To enter, eligible participants (see Section 2 for eligibility requirements) must log on to the Website and submit an essay by 11:59 P.M. Eastern Standard Time (“EST”) by the last day of the applicable Contest Period and in accordance with the essay guidelines set forth in Section 3.
All participants agree to accept and be bound by all terms and conditions of this Contest (the “Rules and Regulations”), any terms and conditions governing the use of the Website (the “Terms of Use”) and/or any applicable privacy policies thereof (the “Privacy Policy”), and to accept and be bound by the decisions of UniversityTutor.com, whose decisions are final and non-appealable with respect to all matters of the Contest, as set forth in Sections 3 and 4 of these Rules and Regulations.
A participant may submit only one essay per Contest. Essay submissions that are incomplete, submitted late, pertain to topics other than the applicable topic for the Contest, or otherwise do not comply with these Rules and Regulations will not be accepted and evaluated as part of the Contest. By entering the Contest, participants agree that UniversityTutor.com will own and maintain all copyrights in all essays submitted, with the perpetual and irrevocable right to use such essays in its sole discretion. UniversityTutor.com may edit, modify, and distribute the submitted essays without limitation and shall be under no obligation to notify or receive any permission from the applicable participant (please see Section 6 for a Privacy Statement).
2. Eligibility
This Contest is open to anyone that is 16 years of age or older or the applicable age of legal consent under the applicable laws of such person’s country or territory.
Previous winners of the contest may not enter again.
Additionally, no participant is required to purchase any services from UniversityTutor.com to participate in or win any award from participating in the Contest.
Additionally no employee or agent of UniversityTutor.com and any other person who is related, directly or indirectly, through a family or business relationship, to a UniversityTutor.com employee or agent, is eligible to participate in the Contest. The Contest is subject to all applicable law(s) and participants who are permanent residents of jurisdictions that prohibit this Contest in their respective jurisdiction and/or the participation in such Contest are not eligible to participate in this Contest.

3. Essay Guidelines
Each essay must be at least 300 words and in response to a monthly essay prompt made available on the Website. All essay submissions must be submitted through the Website by 11:59 P.M. EST by the last day of the Contest Period. Only those essay submissions submitted through the Website will accepted and judged under the Contest. No mailed-in essays will be accepted or considered under this Contest.
Essay submissions must not be of obscene, offensive, or explicit nature. Any participant violating these essay guidelines, the Terms of Use, or the Privacy Policy may be disqualified from the Contest and may also be prohibited from participating in future Contests.
4. Judging and Timing
After the Contest Period, UniversityTutor.com staff will review and select the winning essay for the applicable Contest Period within thirty (30) days of the essay submission deadline for the applicable Contest Period.
Essay submissions will be evaluated equally based upon the following criteria: (i) the overall quality of the writing; (ii) the extent to which the essay is compelling; and (iii) the relevancy of the essay submission to the question prompt.
UniversityTutor.com reserves the right, in its sole discretion in administering the Contest, to disqualify any participant they find or have reason to believe is: (i) tampering with the entry process or the administration of the Contest; (ii) acting in violation of these Rules and Regulations, the Terms of Use, or Privacy Policy; or (iii) plagiarizing any content in any form.
The selection of the winning essay is within the sole discretion of UniversityTutor.com. The administration of the Contest, including, without limitation, determining the eligibility of a participant or essay, evaluating the quality of submitted essay, and awarding of any prizes, is within the sole and absolute discretion of UniversityTutor.com. No participant or person related thereto, has any right to appeal, contest, dispute, or otherwise challenge any aspect of the administration of the Contest. All decisions of UniversityTutor.com are final in all respects.
5. Awards
UniversityTutor.com will use reasonable efforts to announce the winner(s) of the Contest on the Website within thirty (30) days following the applicable Contest Period. If the participant, who is chosen as the winner of the contest, is under the age of 18 or the applicable age of legal consent, the participant must return a copy of the parent or legal guardian's consent prior to being awarded the prize.

UniversityTutor.com reserves the right to later modify the actual prize award(s).
All participants are solely responsible for understanding and complying with any and all federal, state, and local laws, codes, regulations, and ordinances that may apply to the participants and the activities or business in which such participants may engage. There may be tax consequences associated with the prizes and payment received by a Contest winner(s), which may include, without limitation, an obligation to report as income and to pay taxes on such income to federal, state, or local authorities. Each Contest winner is responsible to determine the tax consequences of the income received and to comply with all applicable laws in all respects.
6. Privacy Statement
Upon submission of an essay to UniversityTutor.com, the essay becomes the property of UniversityTutor.com. By entering the Contest, participants grant UniversityTutor.com the right, unless prohibited by law, to use the participant’s name, cities and states of residence, pictures, and likenesses without compensation, notification, or permission, for the express purpose of advertising and publicity in any and all media, now or after, through the world in perpetuity.
7. Disclaimers, Limitations of Liability, Release, and Indemnification
UniversityTutor.com makes no representations or warranties with regard to its administration of the Contest, the usability, reliability, operation or performance of the Website or any functionality associated with the Website. No guarantees are made by UniversityTutor.com that the Contest and/or the Website will operate as expected, foreseen, or intended.
UniversityTutor.com assumes no responsibility for any incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized by this Contest or by any human error which may occur in the processing of essay submissions into or through the Website. UniversityTutor.com is not responsible for lost, late, misdirected, or delayed entries or any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of players on account of technical problems, or traffic congestion on the Internet or at any website or combination thereof.
If, for any reason, the Contest is not capable of being run as planned, including infection of the Website by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of UniversityTutor.com, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest or for any reason UniversityTutor.com deems it necessary, UniversityTutor.com reserves the right to cancel, modify, or delay the Contest in its sole discretion.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: IN NO EVENT SHALL UNIVERSITYTUTOR.COM BE LIABLE TO ANY PARTICIPANT FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR INCIDENTAL DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, DATA LOSS, DATA DESTRUCTION OR ANY OTHER PECUNIARY LOSS, IN ANY WAY ARISING OUT OF OR RELATED TO THESE RULES AND REGULATIONS, EVEN IF UNIVERSITYTUTOR.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Each participant agrees to release UniversityTutor.com, including its respective officers, directors, managers, employees and agents, from any and all liability in connection with or arising from any claims or alleged claims arising from or in connection with the participation in the Contest.
8. Nondiscrimination Policy
In administering the Contest, UniversityTutor.com will not discriminate in any manner, including on the basis of race, color, national, or ethnic origin, and each eligible essay submitted will be evaluated upon the merit of its contents as set forth in Section 4 of these Rules and Regulations.
9. Governing Law and Venue
These Rules and Regulations shall be governed by the laws of the State of Utah, irrespective of any conflicts of law or choice of law considerations. ANY CLAIM OR ACTION IN CONNECTION WITH THIS CONTEST MUST BE BROUGHT EXCLUSIVELY IN A COURT OF COMPETENT JURISDICTION IN THE STATE OF UTAH.
YOU IRREVOCABLY SUBMIT TO THE EXCLUSIVE JURISDICTION OF SUCH COURT IN CONNECTION WITH ANY SUCH CLAIM, ACT OR PROCEEDING. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY WAIVE ANY AND ALL CLAIMS YOU MAY AGAINST THE IMPROPER VENUE FOR ANY SUCH CAUSE OF ACTION BROUGHT FILED IN SUCH COURT AS AN INCONVENIENT OR IMPROPER FORUM.
If any action at law or in equity is necessary to enforce these Rules and Regulations, UniversityTutor.com will be entitled to reasonable fees of attorneys, accountants and other professionals, and costs and expenses in addition to any other relief to which UniversityTutor.com may be entitled.
